Introduction

            According to the due process, laws must be applied to all people with equality and fairness. Both the defendant and the plaintiff must be treated equally before the law, as a person is innocent until proved guilty. According to the constitution, no American citizen should be denied right to life, liberty or freedom without a proper and thorough due process. As a result of this, the 14th amendment contains rights of the accused during a case. These rights are aimed at ensuring that justice prevails to every citizen. These rights are aimed at protecting the accused from the public, state of federal government authorities (Siegel, 2010).
