A major portion of the FLSA is concerned with the classification of employees as exempt or non-exempt. While there are “tests” that we have studied for making this determination, some situations don’t present themselves in an obvious manner. Therefore, many employers choose to write the DOL and ask for its advice. In return, an attorney for the DOL issues an Opinion Letter to the employer answering the employer’s question from the attorney’s legal perspective. Below, you will find a link to the opinion letter section of the DOL website.

On this site, you will find sections for opinion letters about MANY, MANY issues. Your assignment is to search for and locate a letter that gives an employer an opinion about how an employee or a position should be classified (exempt or non-exempt). Once you locate the letter, you are required to download a pdf version of it and attach it to the dropbox contained in this assignment. Then, in the message box, type a brief summary of the employer’s question(s) and the advice given by the DOL.
