Do you believe the grievance process followed by the CBA (Article 7) provided in the resource section is fair and equitable for both labor and management?
Yes I believe the grievance process is spelled out in great detail for both labor and management. It seems fair and equitable for both, for example having each party pay for their own legal representation. Their were a lot of legal terms and it was in great detail giving all of the steps of the process for grievances.
What types of issues should be agreed upon at the first level supervisor level and which ones do you think need to be elevated?
The first level supervisor should handle attendance and basic discipline procedures with employees. The elevated issues, like for HR – harassment, workplace bullying, discrimination should be handled by upper management.
Is the alternative dispute resolution process a viable course of action in most workplace settings? Please explain.
In most professional workplace settings I believe that a.d.r. is a very good alternative to having go to court and pay expensive legal fees. It is also very involved with having to spend a lot of time and energy waiting for the lawyers to file their motions, then waiting if there is a continuance that is filed etc. After going through a divorce in my past, I completely understand the process of the court. I truly believe if I were more of an advanced negotiator and more mature, I would have gone with the mediator option. Maybe I would have been more satisfied with the outcome of the final decision, but hindsight is always 20/20…(I really don’t like that expression now, but couldn’t think of another one to use!).
Good luck to you all in the final two weeks of class.
