Brain herniation
A 22-year old college student Tom is involved in a tragic car accident, and he is now in a coma with a large Brain herniation. Tom’s roommate calls Tom’s parents to let them know what happened. Tom’s accident happened on the East coast and his parents flew from the Midwest to be with him. When they arrived, they were asked if Tom had documentation of a healthcare proxy. Tom’s parents have not discussed this with Tom formally. Tom and his parents have had informal conversations about what they would do for each in this circumstance but never created legal healthcare proxy (advance directive) documentation. Tom’s parents are informed that they cannot make any decisions for Tom at this point because he is a legal adult. Tom’s current physician talked to the organization’s ethical committee and said that he believes Tom has a chance of recovery. However, Tom’s parents are extremely concerned and want a second opinion. They do not want their son to live in a braindead state knowing Tom’s wishes. Tom’s parents believe that Tom would want to be freed from a life of unconsciousness or awakening with very serious deficits.
After several months, Tom’s parents were eventually able to get a court order to move Tom back to the Midwest to seek the opinion of a specialist in the area of brain recovery. The specialist was able to document that Tom did not have a chance of recovering. The court ruled in favor of Tom’s parents to remove Tom from life support.
Tom’s parents wanted to find ways to ensure that people know about the importance of a healthcare proxy as a legacy for Tom’s life.
