If I was the arbitrator in this case, based of the information given, I would side with the officer/union. If there is no written company policy or rule then the sergeant in question has no real bases to make him stop wearing the earing. Although, the earing could be a safety issue. I would come to the decision that then the police department should not be liable for any injuries caused by said accessories if worn on the job but that it could be worn as long as you sign an affidavit to said effect. When it comes to the actual law of the case the officer has the high ground. I would advise that the city, as well as the police department, to go back and redefine their policies regarding clothing and accessories
