Topic 2: Glen Ridge Hypothetical

Read the following scenario and then answer the questions.

Glen Ridge is a small community on the outskirts of Appleton. There are approximately 100 homes in the 15-square-mile town. Bach Industries has just built a factory within the Glen Ridge city limits. They have trucks delivering materials at all hours of the day and night. The factory also emits a horrible odor. After the factory has been running for a few months, the Danders move into town. The Danders are very upset with the noise and smell and get the town to file a lawsuit against the company.

What kind of claim will the town make against the company? What defenses can be used by the company against this lawsuit?

In this case, I will side with the defendant, Katko.  Briney had no business in the property that is no his. When someone has locked their door, it’s not your house, you did not ask for permission and so the plaintiff had no business being there at all………………
