  • In recent Supreme Court case Obergefell v. Hodges, the Court held in a 5–4 decision that the fundamental right to marry is guaranteed to same-sex couples by both the Due Process Clause and the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution. Previously, this issue had been left up to the states. In your opinion, is this a case of basic “civil rights” that deserves protection under the federal government, or is this strictly a state issue? Explain your reasoning.

I believe that the landmark ruling in Obergefell v. Hodges was quite justified as the case represents basic civil right that deserve protection under the federal government. People have a fundamental right to marry and this should not be a state issue. It is a civil rights issues that relies on the equal protection clause…
