DQ 2- Benny Hodges, then a Georgia trooper, arrived at a profile for drug runners delivering drugs into the country through Florida. He found that the typical drug runner would fit the following profile: Male, Hispanic, alone or with a friend, driving North on US95, driving a rented car, driving at the speed limit, between midnight and about 5 in the morning. After seeing this in his work, he began to stop cars meeting this profile and made many large seizures of cocaine. The drivers would consent to searches and he made many arrests. Eventually, the ACLU became involved and complained that the profile was racist and should be banned. The courts eventually supported the ban stating that the profile lacked probable cause. Benny had to stop his proactive efforts. Were the ACLU and courts right? Take a stance on this issue and justify your position either in support of or against Benny’s cases. Were the ACLU and courts right?

In my view, the courts and the ACLU were right in their decisions. Considering the fact that both the court and the ACLU are tasked with the responsibility of individual liberties and rights guaranteed by the United States constitution, it was a good move for the two institutions to support the decision to ban Benny’s profile. Apart from lacking a probable cause, the profile developed by Benny was a violation of the rights of male drivers who preferred driving in the midnight and early morning.
