Summary of the article
According to this article, state laws that deal with the functional behavior assessments (FBA) and the behavior intervention plans (BIP) do not match with literature analysis in this area. This aspect is clearly exhibited by the fact that there are no state laws that require both the BIP and FBA in situations where a student is unable to learn effectively as a result of his or her disability behavior. The author of this article conducted a study on state laws to prove these claims. To achieve this, the author used the following methods;
- Boolean research via the Westlaw database on each state’s regulations that dealt with behavior support plan
- Searching the SEA websites on states which lacked the entries highlighted in step (a) and
- Double-checking the National Early Childhood Technical Assistance (NECTAC, 2011) which had a list of all state regulations that had been updated. From this, the author of this article was able to ascertain that among the 50 states, only 31had statutory provisions of both BIP and IDEA which were in excess of the requirements of IDEA.
Weaknesses of this article
A simple look at this article reveals various weaknesses which make it not only boring to read, but also very complicated. The first weakness here is the absence of an introductory paragraph and conclusion. This makes it difficult for readers to determine what is talking about in the beginning. The absence of the concluding paragraph makes it hard for the reader to actually determine whether the article’s author achieved the goals or objectives of the research study. Another serious weakness of this article is its long sentences. I have to admit that I found it difficult in several occasions to understand what the author was in implying in some of her statements as a result of the long sentences used.

According to this article, schools are required to carry out functional behavioral assessments (FBA) in order to conform to the reauthorization of the individuals with Disability Education Act.
